It is a desire of every contractor who is working through Umbrella Companies to continue their successful contracting career by claiming all the expenses they are entitled to and receiving their pay on time.
Contractors working in UK are required to be attached with either Limited companies or work through Umbrella Companies. Most of them prefer Umbrella scheme due to its simple and hassle free working relationship. Therefore, many questions and issues are required to be addressed in order to help contractors start their contracting career smoothly. Why the payday is not fixed?
The contractors are paid when the Umbrella Company receives the payments from agency. Contractors submit the timesheets while approval of invoice is based on the terms negotiated between the agency and Umbrella Company. Hence, it is not possible to fix a payday to hand over pay to contractors. What Umbrella Companies do to minimize the delay is that they pay the same day when payment is received from the agency.
If my Umbrella Company offers dispensations, why I should submit the receipts?
The HMRC approved list of expenses is ambiguous and contractor must submit the receipts of business expenses like travel, meals and subsistence. The allowance of dispensations by HMRC means that Umbrella Company needs not to provide a separate P11D for each contractor working with it. This does not give any privilege to contractors that they can claim
expenses without any receipt.
Does a two-year rule apply to me?
This rule in general applies to all workers and contractors have to follow this rule too. It simply means that when contractors work with a same client for two years or the contract is extended for such a period they can no longer claim subsistence expenses.
Why it is important to pay NI contributions?
The National Insurance contributions are paid by all permanent or contract workers. The difference between them is that the NI contributions paid by the employers of permanent workers are invincible. On the other hand, these contributions are factored into contractor rates. That’s why contractors earn more than permanent employees.
Do I have to surrender my employment rights?
The contractors are the employee of their Umbrella Companies hence they enjoy most of the employment rights that are offered to permanent employees. These benefits include sick pay, maternity pay, holidays and paternity benefits.
Does my IR35 status is affected when I work through an Umbrella?
Since the contractors are employed by the Umbrella Companies, IR35 is no longer relevant. Therefore, as long as contractors are attached with Umbrella they need not to worry about IR35 legislation.
Is there any difference between business expenses and rechargeable expenses?
The regular business expenses for an Umbrella contractor include travel, meals and accommodation. These expenses are calculated on weekly or monthly basis and are deducted from the contractor’s total monthly income hence reducing the tax amount.
As far as rechargeable expenses are concerned, these expenses are those, which are incurred during course of business and are paid in advance from contractor’s pocket. Such expenses are then included in the weekly or monthly invoice and contractor receives these extra costs apart from his/her regular monthly pay.
Does a contractor become an employee of an Umbrella Company after signing the contract?
After joining an Umbrella Company, the contractor becomes its employee. This relationship is legalized by signing a contract of employment and all the employment rights and duties are part of such a contract. Moreover, the contractor is entitled to ask for the copy of contract from their respective Umbrella Providers.
Since the contractors working through Umbrella Company are its employees so they have no contractual relationship with either agency or client. On the contrary, it is the Umbrella Company, which enters into a contract with agency or client
Moreover, working through Umbrella providers, contractors are protected from any kind of risks associated with contracting. It is here by advised that if an Umbrella Company does not offer employment benefits and financial security there is no point in working through such provider.
